Kelsey Park Avenue

This website aims to disseminate information and promote understanding to all residents of (and adjoining) Kelsey Park Avenue, since it appears many are unaware of these matters.

Historical context

In August 1902 the area of farming land was broken up and sold off for development  starting with the building of houses in Wickham Road. The area  now comprises  Kelsey Park Avenue, Princess Court, Maybury and Lakeside and Kelsey Park Avenue itself. As is known, some of those houses have been demolished and new buildings created in what were once back gardens.

The land which comprises Kelsey Park Avenue was transferred by the owners in 1902 to certain persons on trust to hold it for the benefit of all residents and authorised users. Over the years new trustees have been appointed. Trustees receive no pay or benefits but undertake duties as volunteers and act and intend to do so with the interests of all residents in mind. Their responsibility is limited to the Avenue itself and with no interest in the estates all of which have their own community organisations.

Trustees

As such, title has been passed over the years and is now registered at H.M. Land Registry in the names of the current trustees. Who are: Nick Kanaar (1 Samuel Court), David Crossman (1  Maybury), Sheila Gardener (5 Samuel Court), and Jim Bell (Lakeside).  Trustees are appointed  by existing trustees after enquiries seeking volunteers.

Obligations of Trustees and Residents

To look after the Avenue the obligations are retaining the “Private Road” status, keeping the area tidy and presentable and with street lighting and overseeing the physical state of the road and its upkeep and refurbishment. Also, in the interest of all, in making regulations and directions as to conduct and safety.

The financial aspects are reasonably straightforward but do put a burden on at least one trustee in having to pay for services (gardeners, lighting and repairs and maintenance of the surface and drainage) and calculating the shares of each residential community and making sure invoices are paid.

Invoices are rendered twice a year at six monthly intervals showing all expenditure and making provision for a reserve fund to provide a cushion in the future for complete road surface renewal. A small sum is recovered from Princess Court for its limited use and access to its garages.

The detailed sharing of all costs has developed over the years as changes were made to the estate with new buildings. The total is broken down into 125 “units” varying according to size and amount of perceived use and access.

The breakdown is as follows:-

There is a right of way from homes to Wickham Road which is conditioned on payment of the upkeep charges as above but there is no legal right to park anywhere and, even less, to claim exclusive rights to park (or object to people parking) any particular place or area."

The Trustees have become concerned that so many residents are unaware of the legal position and  wish all to be informed. They are particularly concerned that individual communities have seen fit to carry out works and authorise trespass of equipment and vehicles without adequate care and attention and have acted in an unneighbourly way or to take remedial steps to repair damage. Examples are the presence of skips without so much as prior notification and for unreasonable periods of time and the provision in unsightly places of “portaloos” to the distress of residents.

The Trustees will be pleased to hear from one and all with any  queries, thoughts, ideas and suggestions  concerning the Avenue or any use or regulations and from anyone interested in acting as a trustee.
